Resolution of Disputes and Remedies on Electricity Supply

this comes under the act Electricity Supply regulation 2006.
Resolution of Disputes By Regulator.

1. the regulator must, in relation to any dispute arising out of this act, if it is a dispute between licensees , act asa mediator if so requested by both parties to the Dispute.
2. If it is a dispute between a customer or end user on the one hand and license registered person, a person who trades is on an other hand, settle that dispute by such means and on such terms as the Regulator thinks fit.
3. the Regulator may appoint a suitable person to act asa mediator on its behalf or any action or decision of a person so appointed is deemed to be an action by or decision of the Regulator.
4. The higher authority must prescribe the procedure to be fallowed in the mediation and the fees to be paid.

Investigations.

The regulator must be , in applicable circumstances , act its own instance or on recipt of a complaint or inquiry relating to the generatiom, transmittion, distribution or trading , investigate

1. of discrimination regarding tariffs or conditions of acesss if a licensee is invloved , of fialure to abide by its licensing conditions. or
2. on recipt of a report under Subsections the regulator may institute a formal investigation.
3. upon instituteing a formal investigation under sub Section.
4. the Regulator may appoint a person to chair the investigations and as many persons as may be necessary to assist with the investigations.
5. the chair and assisting personels must have to investigate according to the formal procedure.
6. on completion of the investigation the person chair must submit its report to the Regulator.
7. The Regulator act in accordance with the report.

Electricity Supply Regulation Act 2006

Objective of this act is

(1)- to achieve the effective, sustainable,orderly comand and operation of Electricity infrastructure in the world.

(2)- To ensure that the interests and needs of present and future electricity customers and end users are safeguarded and met, having regard to the governance, efficiency. effectiveness and long-term sustainability of the electricity supply industry within the broader context of economic energy regulation.

(3)- facilitate investment in the Electricity supply Industry.

(4)- Facilitate universal acess to Electricity.

(5)- promote the use of diverse energy sources and energy efficiency; promote competitiveness and customer and end user choice.

(6)- Facilitate a fair balance balance between the interests of customers and end users, licensees, investors in the electricity supply industry and the public.

Powers and Duties of Regulator.

The Regulator must
(1)- consider applications for licenses and may issue licence ,the operation of generation, transmission and distribution facilities; the import and export of electricity;
(2)- trading;

(a)- regulate prices and tariffs.
(b) - register persons who are to register with the Regulator where they are not required to hold a licence.
(c)-issue rules designed to implement the national government's electricity policy framework, the integrated resource plan and this Act.
(d)- establish and manage monitoring and information systems and a national information system, and co-ordinate the thereof with other relevant information.

(4)- Enforce performance and compliance, and take appropriate steps in the case of non-performance.

(5)- may mediate disputes between generators , distributors, customers or end users.

Advisory Forums.

The Regulator may appoint forums consisting of as many members of the Regulator, employees of the Regulator and other persons as rnay be necessary to advise the Regulator in general or on a particular matter.

Customer and End User Forums.

The Regulator may establish customer or end user forums consisting of as many members of the Regulator, licensees, employees of the Regulator and categories of customers or end users as may be necessary to advise the Regulator on matters affecting customers or end users in general, or a category of customers or end users in particular.
The Regulator must require a licensee to establish and fund a customer or end users in the manner set in the licence held by such a person.
